The Weeknd Slapped With Copyright Lawsuit Over Smash Single ‘The Hills’

The Weeknd might feel like running for “The Hills” right now. Or maybe not.

The Canadian musician — real name: Abel Makkonen Tesfaye — has been slapped with a copyright infringement lawsuit over his chart-topping single “The Hills,” which the suit claims infringed on the song “Revolution,” featured in the film “The Machine.”

According to the lawsuit, composer Tom Raybould was commissioned to write the score for the film, which first publicly screened at the Tribeca Film Festival in April 2013. The soundtrack for the film, which contained the track, was released in April 2014.

The suit claims that song co-author Emmaunel Nickerson — aka. Million Dollar Mano — sent Raybould a direct message on Twitter in March 2015, telling him, “I sampled your music might make it 2 the weeknd next album. Huge fan of what you did 4 the machine movie!”

“The Hills” was released in May, rising to the top of the Billboard Hot 100 chart.

The suit names numerous other defendants, including Nickerson, Universal Music Group, Republic Records and Sony/ATV Music Publishing.

Alleging copyright infringement, unjust enrichment and other counts, Cutting Edge Music (Holdings), the licensee for Raybould’s score, is asking for a decree that “The Hills” infringes on “Revolution,” and unspecified damages — or, in the alternative on the infringement count, statutory damages “in the amount of $150,000 for each infringement.”

“The lawsuit speaks for itself, and I appreciate my publisher the Cutting Edge Group standing up for composers in situations like the one I’m in,” Raybould told TheWrap in a statement.

Added Cutting Edge CEO Philip Moross, “We at the Cutting Edge Group will always work aggressively to protect our copyrights and the composers who write music for us.”

Pamela Chelin contributed to this report.

Wrap-Ranker Oscar Poll: What Should Win Best Original Song?

$
0
0

After narrowing down from a list of hundreds of possible choices, we’re down to five nominees for this year’s Academy Award for Best Original Song.

The Weeknd’s “Earned It” from “Fifty Shades of Grey” was the Canadian singer’s second top 5 hit before he would rule the summer of 2015 with concurrent No. 1 hits in “Can’t Feel My Face” and “The Hills.” The song’s video was directed by the film’s director, Sam Taylor-Johnson, and featured an appearance by star Dakota Johnson.

Sam Smith’s “Writing’s on the Wall” from “Spectre” is the first James Bond movie theme to reach No. 1 on the U.K. singles chart. Despite mediocre reviews and lackluster success outside the U.K., it is coming off a Golden Globe win for Best Original Song.

Lady Gaga and Diane Warren’s “Til It Happens to You” focuses on the idea of placing oneself in the shoes of someone who is suffering and trying to imagine the pain of what they are going through. Attached to the documentary “The Hunting Ground,” which details cases of sexual assault on American college campuses, the song is an effective emotional pull.

Vote for this year’s Best Original Song.

iHeartMedia and Turner Broadcasting announced the finalists for the 2016 iHeartRadio Music Awards on Tuesday.

Taylor Swift leads the field with eight nominations and will vie for the first “Female Artist of the Year” award, while The Weeknd received seven nominations, including one in the inaugural “Male Artist of the Year” category.

Other artists who have received multiple nominations include Adele, Drake, Justin Bieber, Ed Sheeran, Luke Bryan and Sam Smith. All nominations are listed below.

This year’s ceremony will also feature performances by Justin Bieber and Meghan Trainor.

Among last year’s winners were Smith for Best New Artist, Jason Aldean’s “Burnin’ It Down” for Country Song of the Year and Swift, who won Artist of the Year, Song of the Year and Best Lyrics.

This year, the iHeartRadio Music Awards will feature 31 categories, including new awards for “Best Tour,” “Best Duo/Group of the Year” and “Latin Song of the Year,” as well as individual awards for “Artist of the Year” in music’s biggest genres.

“Our awards are not chosen by a mysterious panel of judges,” said John Sykes, president of iHeartMedia’s Entertainment Enterprises. “They are a true reflection of the artists and songs our listeners supported all year long.”

For the first time ever, tickets to the iHeartRadio Music Awards are going on sale to the general public. As a signature sponsor of the event, Capital One cardholders will have the opportunity to purchase them first.

The show will be televised live on TBS, TNT and truTV at 8 p.m. ET/5 p.m. PT on April 3 and will be simulcast on iHeartMedia stations nationwide, as well as on the iHeartRadio digital music platform.

Grammy-winning singer The Weeknd has ended plans to join Rihanna‘s ‘Anti’ tour, according to reports.

The singer, whose real name is Abel Tesfaye, had plans to join Rihanna for the European leg of her tour, but he may well be bowing out because of his own success.

“Due to some unforeseen changes with upcoming projects, The Weeknd will no longer be joining Rihanna on her upcoming international Anti World Tour,” read a statement from Live Nation and as reported in FADER. The news was also reported on the HotNewHiphop.com web site.

Big Sean will continue to support Rihanna on that leg of the tour, which begins June 17 in Amsterdam. Her current U.S. tour started March 12 and ends on May 18.

The Weeknd, Justin Bieber Lead Billboard Music Awards Finalists

The finalist list for the Billboard Music Awards was unveiled on “Good Morning America” on Monday, and The Weeknd, Justin Bieber, and Drake have come away with the most nominations, including a nomination for Top Artist.

The Weeknd, who is a finalist for the first time this year, leads the pack with 16 nominations, followed by Bieber with 11. The other Top Artist nominees are Drake, Adele, and this year’s top Grammy winner, Taylor Swift. Drake has 10 nominations, and Adele and Swift each have eight.

Swift currently holds the record for most BBMA trophies with 20. She could add to that record this year or be overtaken by Bieber or Adele, who have each won 13 BBMA trophies in their careers. Drake and The Weeknd are each seeking their first BBMA trophy this year.

Billboard Music Awards finalists are based on album and digital song sales, radio airplay, streaming, touring and social-media interactions — measurements that are tracked year-round by Billboard and its data partners, including Nielsen Music and Next Big Sound.

The show will be broadcast live from the new T-Mobile Arena in Las Vegas on Sunday, May 22, at 8 PM ET on ABC. Hip-hop artist Ludacris and R&B star Ciara will host.

The 2016 Billboard Music Awards are produced by Dick Clark Productions. Allen Shapiro, Mike Mahan, Mark Bracco, Barry Adelman and Robert Deaton are Executive Producers.

Donald Trump Appearance Prompts The Weeknd, Belly to Cancel Jimmy Kimmel Performance

As Donald Trump’s presence sparked protests across Southern California Wednesday, the polarizing GOP candidate also cost Jimmy Kimmel his musical guests for the night.

R&B singer The Weeknd and rapper Belly both canceled their performance on “Jimmy Kimmel Live!” because Trump was set to appear on the episode, according to the Associated Press.

“I feel like the way I was raised was to be able to see through all the titles in this world — from religion to race,” Belly said in a statement. “I just didn’t want to feel like I was a part of a celebration for somebody who has beliefs that majority of us don’t agree with.”

A representative for “Jimmy Kimmel Live!” told TheWrap that the show had no comment on the matter.

The Weeknd won two Grammy Awards earlier this year, including best urban contemporary album for “Beauty Behind the Madness.” Belly has co-written many of The Weeknd’s hits, including “Earned It,” ”The Hills,” ”Into the Night” and “Often.”

The Weeknd appears on Belly’s song “Might Not,” which they were set to perform on Kimmel’s show.

Belly, who’s signed to Jay Z’s Roc Nation management, went on to say, “I’m here on a campaign of positivity and love and to contribute what I can to music. I create songs people go to sleep and wake up to, songs that they fall in love to.

“For me, being Muslim and being somebody that appreciates my access here in America, I love the fact that I’m able to be here. To play my part in this business is a privilege and a beautiful thing. The fact that I could lose that ability through the actions of someone such as Donald Trump isn’t right to me. At all.”

Belly shared an Oscar nomination for best original song with The Weeknd for “Earned It,” which appears on the “Fifty Shades of Grey” soundtrack.

Fortunately, if Trump is elected president, both artists have other countries to fall back on. Belly, whose real name is Ahmad Balshe, was born in Palestine, but is now based in Ottawa, Canada. While The Weeknd, a.k.a. Abęl Makkonen Tesfaye, is from Toronto.

Donald Trump Should Pick His VP ‘Celebrity Apprentice’ Style, Jimmy Kimmel Says

After talking about him almost every night in his opening monologue, Jimmy Kimmel had Donald Trump on as his guest again Wednesday.

During the jovial interview, Kimmel suggested that the GOP candidate return to his reality TV roots and pick his vice president just as he did on “Celebrity Apprentice.”

“Why don’t you get these guys all in a room and then each week — it would be the highest rated show in television — you eliminate one person and then they go back to wherever the hell they came from?” he suggested.

“This is why I would be your best vice president!” the late-night host pledged, reveling in his great idea.

While Trump’s running mate has been hotly debated, Kimmel kicked off his own V.P. campaign last week.

See the video below of him announcing his promise to never stop fighting — “unless ‘Game of Thrones’ is on.”

They say it takes a village to raise a child, but apparently it takes a whole team of Trump supporters to come up with the nasty nicknames for his opponents, such as “Lying Ted, Crazy Bernie, Crooked Hillary,” as revealed later in the light-hearted banter.

“The team is right there,” Trump told Kimmel during his visit on Wednesday.

Kimmel opened the show with his usual brand of dry humor, telling the audience: “Tonight, those of you watching at home will have the rare opportunity to see Donald Trump on television.

“Trump is here in Hollywood, and I thought this was interesting, he has promised to make Hollywood Boulevard great again, by building a wall around Bill Cosby‘s star on the Walk of Fame. And Guillermo is gonna pay for it!”

Not everyone thought that Trump’s appearance on the ABC late-night show was funny, however, as R&B singer The Weeknd and rapper Belly both canceled their scheduled performance on “Jimmy Kimmel Live!” to protest the Republican candidate’s prior remarks about race.

“I feel like the way I was raised was to be able to see through all the titles in this world — from religion to race,” Belly said in a statement, according to the Associated Press. “I just didn’t want to feel like I was a part of a celebration for somebody who has beliefs that majority of us don’t agree with.”

A representative for “Jimmy Kimmel Live!” told TheWrap that the show had no comment on the matter.

A number of Trump protesters were also spotted on Hollywood Blvd., near Kimmel’s studio, before the taping at around 4 p.m. PT.

Earlier Wednesday, minor violence erupted at Trump’s rally near Disneyland in Anaheim, California, as pro- and anti-Trump groups threw verbal abuse at each other and police began arresting some protesters.

One trash can was set on fire, some protesters threw rocks, and large throngs of police tried to push the remaining demonstrators away, according to the Los Angeles Times.

At least seven adults and one juvenile were arrested over the course of the day, with many taken into custody after police declared an unlawful assembly.

‘Hamilton’ Creator Lin-Manuel Miranda to Host ‘SNL’ Next Month

History in the making? “Hamilton” composer, lyricist and star Lin-Manuel Miranda has been booked to host the October 8 “Saturday Night Live.”

The Emmy, Grammy, Tony and Pulitzer Prize-award winner will be joined by Twenty One Pilots, which is also making their “SNL” debut as musical guest that evening.

That duo — Tyler Joseph and Josh Dun — recently became the first alternative group ever to have two simultaneous singles in the Top 5 on the Billboard Hot 100: “Ride,” from their multi-platinum studio album “Blurryface,” and “Heathens,” from “Suicide Squad: The Album.”

As previously announced, “SNL” returns Oct. 1 with host Margot Robbie and musical guest The Weeknd. This year, “SNL” added new players Alex Moffat, Melissa Villaseñor and Mikey Day to the cast. The trio effectively replaces Taran Killam, Jay Pharoah and Jon Rudnitsky. “Wild ‘N Out” alum Day was actually a writer on the show, ironically penning plenty for Killam in the past.

Fired fan-favorites and “SNL” veterans Killam and Pharoah leave big shoes to fill, though Rudnitsky was one-and-done as a featured act — he struggled for camera time on the highly competitive program. Don’t feel too badly for Killam and Pharoah, they both landed on their feet over at Showtime.

Saturday Night Live” is produced in association with Broadway Video. The creator and executive producer is Lorne Michaels.

Chance the Rapper celebrated his 3 Grammys for his streaming-only “Coloring Book” album by rocking out with Migos (“Bad and Boujee”) at the GQ party at the Chateau Marmont.

The other major must-hit was Republic’s bash at Catch, which had a crowd of invitees pouring on to Melrose Avenue .

Inside, label co-founder /CEO Monte Lipman welcomed Grammy host James Corden and Stevie Wonder.Back at GQ, Chance stood right in the lobby of the Chateau greeting guests as they arrived.  In turn, Quincy Jones (center) and GQ Editor-In-Chief Jim Nelson greeted the man on the cover of this month’s issue.

Katy Perry made a wardrobe change from her “We the People” performance of new hit “Chained to the Rhythm” and cruised through Universal’s soiree downtown before arriving at the Chance victory partySnoop Dogg and Macy Gray surround the host.

Chance remained in the same blue sweater that he had worn on the show. A grab-your-own hat rack of the Chicago native’s signature “3” hat led to a highly uniformed crowd within a few minutes.

Maren Morris and Ryan Hurd grabbed one of the choice perches in the center of the Chateau courtyard. Morris, who had a breakout moment performing on the telecast, was once rejected from both “American Idol” and “The Voice”.

Ty Dolla Sign and Skrillex didn’t put on the “3” hats like everyone else, but they have been on Team Chance. Skrillex performed at Chance’s hometown “Magnificent Colorind Day” festival in Chicago last summer.

Before Chance and Migos rocked the living room, DJ Oreo was spinning fellow windy city phneom Kanye ‘s songs back to back for the Chicago-heavy crowd. “Homecoming” and “Runaway” warmed up the crowd for Migos as rapper Lil Yachty sat on the DJ booth.

Christina Milian and Snoop Dogg were happy not to be stuck outside, where the fire marshall had to temporarily shut down access the door during the performances.

Milian also had her girl squad: The Kaney video dancer who went viral (Teyana Taylor) and Milian’s frequent running mate Karrueche Tran, the woman who became the instigation for the Chris Brown and Soulja Boy celebrity beef boxing match.

GQ Publisher Howard Mittman and Eric Ray Davidson, the man who shoots a ton of the magazine’s celebrity profiles and occasionally gets called on to fetch a phone out of a pool after rowdy GQ parties at the Chateau.

Meanwhile over at the Republic party at Catch, The Weeknd and Stevie Wonder were two of the bold face names at the packed rooftop space.

Jason Derulo had been one of the first to arrive, eating dinner in Stevie Wonder’s reserved table before the Motown legend arrived.

The Fifth Harmony ladies were on the scene at the Fiji water hosted bash: Normani Kordei, Ally Brooke, and Lauren Jauregui

Jessie J and Joel Madden

The crowd included a late-arriving Nicole Scherzinger, with Pussycat Doll founder Robin Anton,

Mr. Brainwash, Monte Lipman, and Universal Music Grouup CEO Sir Lucian Grange.

Heidi Klum and David Foster held down a banquette on the east side patio…

Which overlooked this projection on to the Pacific Design Center next door.

Republic Group President Charlie Walk with the much-taller-in-person Afrojack.  Once inside, the Duth producer hung with Jessie Waits, the Vegas nightlife executive responsible for XS and Tryst who is opening up the reported $4 billion Alon project in the next few years.

Painted models were camouflaged, passing tequila sodas throughout the space.Don’t sleep on Stanaj. The  Republic artist’s long-awaited EP recently arrived. His showcase packed the Sayer’s Club full with faces like Randy Jackson and Jason Flom before it even got dark out one night last summer.

Anthony Mackie hung with Catch owner Mark Birnbaum, Nick Cannon made the scene, and model/actress Maya Henry held court in the room that also included Nicole Richie, Skylar Grey, and Aurora.

Adrien Brody and girlfriend Lara Lieto.

Back off “Bachelor” Nick Viall. Your big night only comes on Mondays.

Lines of annoyed invited guests were a common issue all over town. This was the scene at Catch. In addition the Chateau (mentioned above), Warner Music’s event at Milk Studios reportedly hit capacity on the early side of the night.

Over at Milk Studios, Spencer Ludwig was one of the three headliners (with Kehlani and Gallant) at Warner Music’s Block Party, where NFL QB Russell Wilson, Katharine McPhee, and Rita Ora mixed as the Rémy Martin flowed.

At Warners, the Black Eyed Peas were one Fergie short of a reunion: Taboo, apl.de.ap, and will.i.am.

Kendrick Lamar, Katy Perry, The Weeknd Lead MTV Video Music Awards Nominations

Kendrick Lamar, Katy Perry and The Weeknd lead nominations for the 2017 Video Music Awards (VMAs), MTV announced Tuesday.

Rather than release the full list all at once, MTV opted to unfold each category one-by-one and via Instagram Live. According to a statement from the network, this is an unprecedented move, as no other award show has ever utilized Instagram Live to deliver its full list of nominees.

Also noteworthy is the award show’s list of categories. As with this year’s “MTV Movie & TV Awards,” the VMAs will feature “genderless” categories. Former “Best Male Video” and “Best Female Video” categories are now consolidated into the gender-neutral “Artist of the Year.” They also added a new category, “Best Fight Against the System,” which the network says will “celebrate videos that inspire viewers to stand up and fight injustice.”

Artists receiving the most nominations this year are Kendrick Lamar, Katy Perry and The Weeknd. Rapper Lamar received eight nominations for his video, “HUMBLE.” Perry and The Weeknd each scored five nominations.

Fans can also vote for their favorite artists or collaborations across eight different categories for a chance to win a trip to this year’s award show.

The MTV Video Music Awards will take place Sunday, Aug. 27 at The Forum in Inglewood, California and will also stream live on MTV.

Eminem, Beyonce, The Weeknd Reported to Headline Coachella 2018

A website that has broken the news of Coachella’s headliners for the last two years reports that 2018’s stars will be Eminem, Beyonce and The Weeknd. Consequence of Sound notes that this would be the first time in the nearly two decades of the Southern California desert festival that a rock band won’t headline.

The site first reported in October 2015 that the New York-based dance-punk outfit LCD Soundsystem would headline Coachella 2016 as the start of a reunion tour. The site was lambasted by the band’s representatives  but ultimately were proven correct when James Murphy and company joined the semi-reunited Guns N’ Roses and Calvin Harris as headliners. The site has also leaked news of other festival headliners as far back as 2010.

Beyonce dropped out of her headlining slot last year due to her pregnancy, but said she would return in 2018.

Eminem released his latest album, “Revival,” on Friday. The Weeknd’s most recent album was 2016’s “Star Boy.”

Goldenvoice, which produces Coachella, did not immediately respond to TheWrap’s request for comment. Neither did reps for Eminem and The Weeknd.

The lineup is expected to be released in early January. Coachella will take place April 13-15 and April 20-22 at the Empire Polo Club in Indio.

The Weeknd Cuts Ties With H&M Over ‘Coolest Monkey’ Hoodie

The Weeknd isn’t monkeying around — he’s through with H&M.

The musician, who had a partnership with H&M, said Monday that he was severing ties with the clothing company, after it ran an ad featuring a black child wearing a hooded sweatshirt reading, “Coolest monkey in the jungle.”

In a tweet Monday, The Weeknd said that he was “shocked and embarrassed” by the image, which he was “deeply offended” by.

“Woke up this morning shocked and embarrassed by this photo. i’m deeply offended and will not be working with @hm anymore…,” the musician wrote.

The Weeknd wasn’t the only one to take offense to the ad. H&M has caught major heat over the last couple of days for the image. New York Times columnist Charles M. Blow, for one, asked the company over Twitter, “have you lost your damned minds?!?!?!”

The company issued an apology for the ad Monday, saying that in addition to removing the image from its platform it had also removed the garment itself from its inventory.

“We understand that many people are upset about the image. We, who work at H&M, can only agree. We are deeply sorry that the picture was taken, and we also regret the actual print,” H&M said. “Therefore, we have not only removed the image from our channels, but also the garment from our product offering globally.”

The company continued, “It is obvious that our routines have not been followed properly. This is without any doubt. We will thoroughly investigate why this happened to prevent this type of mistake from happening again.”

H&M Apologizes, Again, for ‘Coolest Monkey’ Ad: We ‘Got This Wrong and We Are Deeply Sorry’

Clothing company H&M has issued yet another apology, after drawing substantial criticism for an ad featuring a black child wearing a sweatshirt bearing the message, “Coolest monkey in the jungle.”

The new mea culpa, which is billed as an “unequivocal apology for poorly judged product and image,” states in part, “We would like to put on record our position in relation to the image and promotion of a children’s sweater, and the ensuing response and criticism.

” Our position is simple and unequivocal – we have got this wrong and we are deeply sorry,” the apology, issued Tuesday, continued.

While H&M said that the use of the image was “accidental in nature,” the company nonetheless added, “this doesn’t mean we don’t take it extremely seriously or understand the upset and discomfort it has caused.”

The company drew fire for the ad early in the week. Initially, the company reacted by removing the image, ultimately choosing to remove the garment from sale altogether.

Prominent critics of the ad included the musician The Weeknd, who had a partnership with H&M but signaled his intention to cut ties with the company on Monday after being made aware of the ad. NBA player LeBron James and rapper/mogul Sean Combs were also among the high-profile critics of the ad.

H&M issues unequivocal apology for poorly judged product and image

To all customers, staff, media, stakeholders, partners, suppliers, friends and critics.

We would like to put on record our position in relation to the image and promotion of a children’s sweater, and the ensuing response and criticism.

Our position is simple and unequivocal – we have got this wrong and we are deeply sorry.

H&M is fully committed to playing its part in addressing society’s issues and problems, whether it’s diversity, working conditions or environmental protection – and many others. Our standards are high and we feel that we have made real progress over the years in playing our part in promoting diversity and inclusion. But we clearly haven’t come far enough.

We agree with all the criticism that this has generated – we have got this wrong and we agree that, even if unintentional, passive or casual racism needs to be eradicated wherever it exists. We appreciate the support of those who have seen that our product and promotion were not intended to cause offence but, as a global brand, we have a responsibility to be aware of and attuned to all racial and cultural sensitivities – and we have not lived up to this responsibility this time.

This incident is accidental in nature, but this doesn’t mean we don’t take it extremely seriously or understand the upset and discomfort it has caused.

We have taken down the image and we have removed the garment in question from sale. It will be recycled.

We will now be doing everything we possibly can to prevent this from happening again in future.

Racism and bias in any shape or form, conscious or unconscious, deliberate or accidental, are simply unacceptable and need to be eradicated from society. In this instance we have not been sensitive enough to this agenda.

Please accept our humble apologies.

Clothing store H&M has lost another celebrity partnership after receiving backlash for an ad featuring a black child wearing a hooded sweatshirt that read, “Coolest monkey in the jungle.”

Rapper G-Eazy said on Instagram Tuesday that he is ending is partnership with the global chain, adding that his “excitement over our global campaign quickly evaporated” after seeing the “disturbing image.”

“Over the past months I was genuinely excited about launching my upcoming line and collaboration with @HM,” G-Eazy’s Instagram post said. “Unfortunately, after seeing the disturbing image yesterday, my excitement over our global campaign quickly evaporated, and I’ve decided at this time our partnership needs to end.”

He said it did not matter whether or not the image was an oversight. “It’s truly sad and disturbing that in 2018, something so racially and culturally insensitive could pass by the eyes of so many (stylist, photographer, creative and marketing teams) and be deemed acceptable,” he said.

Over the past months I was genuinely excited about launching my upcoming line and collaboration with @HM… Unfortunately, after seeing the disturbing image yesterday, my excitement over our global campaign quickly evaporated, and I've decided at this time our partnership needs to end. Whether an oblivious oversight or not, it's truly sad and disturbing that in 2018, something so racially and culturally insensitive could pass by the eyes of so many (stylist, photographer, creative and marketing teams) and be deemed acceptable. I can't allow for my name and brand to be associated with a company that could let this happen. I hope that this situation will serve as the wake up call that H&M and other companies need to get on track and become racially and culturally aware, as well as more diverse at every level.

“I can’t allow for my name and brand to be associated with a company that could let this happen,” he finished. “I hope that this situation will serve as the wake up call that H&M and other companies need to get on track and become racially and culturally aware, as well as more diverse at every level.”

A rep for H&M provided a response to TheWrap on Wednesday, saying the brand’s leadership “completely understand and agree with” G-Eazy’s choice to end his partnership. “We completely understand and agree with his reaction to the image,” the statement said. “We have got this wrong and we are deeply sorry. We strongly believe that racism and bias in any shape or form, deliberate or accidental, are simply unacceptable. We completely understand the criticism and we agree with it. We have taken down the image and we have removed the garment from sale. We are now investigating internally to avoid this happening again. We will continue the discussion with G-Eazy and his team separately.”

R&B singer The Weeknd, who has an H&M collection, said Monday that he was “deeply offended” by the image, and would no longer work with the clothing brand.

H&M has apologized twice for what the company has called an accident.

“H&M issues unequivocal apology for poorly judged product and image to all customers, staff, media, stakeholders, partners, suppliers, friends and critics,” the company said in a statement Tuesday.

“H&M is fully committed to playing its part in addressing society’s issues and problems, whether it’s diversity, working conditions or environmental protection – and many others,” Tuesday’s statement continued. “Our standards are high and we feel that we have made real progress over the years in playing our part in promoting diversity and inclusion. But we clearly haven’t come far enough.”

“We understand that many people are upset about the image. We, who work at H&M, can only agree. We are deeply sorry that the picture was taken, and we also regret the actual print,” H&M said in a prior statement Monday. “Therefore, we have not only removed the image from our channels, but also the garment from our product offering globally.”
